1.1 Who we are & acceptance
Diodia (“Diodia”, the “App”, “we”, “us”, “our”) is a mobile application published by [PUBLISHER LEGAL ENTITY], [PUBLISHER ADDRESS] (the “Publisher”). By downloading, installing, or using the App you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the App.
These Terms are a contract between you and the Publisher. Your use of the Apple App Store or Google Play is additionally governed by their respective terms.
1.2 What Diodia is (and is not)
Diodia is a toll-cost calculator. It helps you estimate the cost of road tolls for a trip in Greece before you travel, shows the toll plazas on your route with an indicative price for each, and — for users who unlock the Pro feature set — speaks brief toll-proximity alerts aloud through your device's audio output while you drive.
Diodia is not a navigation app. It does not provide turn-by-turn directions and is not a substitute for a maps or navigation application. Use Diodia alongside your usual maps app. Diodia does not direct your driving, and you remain solely responsible for how you drive, for obeying traffic laws, and for operating your device safely and lawfully.
1.3 Prices are indicative
Toll prices shown in the App are indicative estimates only. They include VAT (currently 24%) and vary by vehicle category, operator, route, and payment method. Prices change and may be out of date. Diodia is not the merchant of record for any toll, does not process or collect toll payments, and has no control over the amounts actually charged by toll operators. The actual amount you pay is set and collected by the relevant toll operator. Where possible we link you to the operator so you can confirm the current price. We do not guarantee that any price shown is accurate, complete, or current, and we are not liable for any difference between an indicative price and the amount an operator charges you.
1.4 The Pro unlock and pricing (read with §1.7)
Some features (for example the spoken proximity alerts and locally stored saved routes) require a purchase to unlock (the “Pro unlock”). All purchases are sold and charged through Apple’s or Google’s in-app purchase system, not directly by the Publisher. The price, currency, and available purchase options are those shown in the App Store or Google Play at the time of purchase; promotional pricing may apply from time to time. Prices may change for future purchases — see §1.13 (Price changes).
The Pro unlock is offered as both of the following, as presented in the App at the time of purchase:
(a) A one-time “Lifetime” purchase. A single non-consumable in-app purchase (€14.99) that unlocks the Pro features on your store account — the actual price charged is the one shown in the store at purchase. Where this option is described as “lifetime”, that word means the lifetime of the App / of the Diodia service — that is, for as long as we continue to offer the App and the relevant feature. It does not mean your personal lifetime and does not guarantee that the App or any feature will be available forever or for any minimum period. §1.14 (“Lifetime”) defines exactly what this purchase does and does not give you and is an essential part of it, together with §1.7 (Changes, availability and discontinuation) and §1.8 (Disclaimers).
(b) An auto-renewing subscription. A subscription that unlocks the Pro features for a recurring period (a monthly plan at €0.99/month and an annual plan at €7.99/year — the actual price and periods charged are those shown in the store at purchase). For any auto-renewing subscription:
- Auto-renewal. Your subscription renews automatically at the end of each period and your store account is charged for the next period, unless you cancel at least 24 hours before the end of the current period.
- Managing / cancelling. You manage and cancel your subscription through your Apple or Google account settings, not through us; we cannot cancel it for you. Cancellation takes effect at the end of the current paid period, and you keep access until then.
- Refunds for partial periods. We do not provide refunds for partial or unused subscription periods, except where a refund is required by applicable law or granted under Apple/Google policies.
Restore purchases. If you reinstall the App or move to a new device using the same store account, you can restore an active Pro unlock at no additional charge using the in-app “Restore Purchases” function.
1.5 Refunds
Because the Pro unlock (whether one-time or subscription) is purchased through Apple or Google, refunds are handled by Apple or Google under their applicable policies and under applicable law. We do not separately process payments and generally cannot issue refunds ourselves. Nothing in these Terms limits any refund or withdrawal right you have under mandatory consumer law (see §1.15).
1.6 Acceptable use
You agree to use the App only for lawful purposes and not to: (a) use the App in a way that distracts you from safe driving or violates road-traffic law; (b) reverse-engineer, decompile, or attempt to extract source code except to the extent this restriction is prohibited by law; (c) interfere with, overload, or attempt to gain unauthorised access to the App or its supporting infrastructure; (d) misuse, scrape, or resell the toll data or other content; or (e) use the App in breach of any applicable law or third-party rights.
1.7 Changes, availability and discontinuation
The App is provided on an “as available” basis. We do not guarantee that the App, or any particular feature (including the Pro features), will be available without interruption or for any minimum or indefinite period.
We reserve the right, at our discretion, to modify, suspend, or discontinue the App or any of its features, in whole or in part, at any time. Where we discontinue the App or a paid feature and it is practicable to do so, we will give reasonable prior notice (for example, an in-app notice or a notice on our listing or website).
Where you bought the Pro unlock as a one-time “Lifetime” purchase (§1.4(a)), you acknowledge that it is a one-time purchase for access to features of a service that may evolve or be discontinued, and that any “lifetime” description is limited to the lifetime of the service, as defined in §1.14. To the maximum extent permitted by applicable law, discontinuation of the App or a feature, by itself, does not entitle you to a refund of, or compensation for, the one-time Pro unlock, beyond any remedy required by mandatory consumer law or by the applicable Apple/Google store policies.
Where you hold an auto-renewing subscription (§1.4(b)), billing simply stops on cancellation or on discontinuation of the App, and no future periods are charged.
This §1.7, together with §1.4, §1.8, §1.9 and §1.14, does not exclude or limit your mandatory statutory consumer rights — see §1.15.
1.8 Disclaimers
To the maximum extent permitted by applicable law, the App and all content (including routes, plaza locations, and indicative prices) are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, accurate, secure, or that alerts will always fire correctly or in time. You must not rely on the App as your sole source of safety-critical, navigational, or pricing information.
1.9 Limitation of liability
To the maximum extent permitted by applicable law, the Publisher shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the App — including any reliance on an indicative price, a missed or late alert, or the discontinuation of the App or a feature.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under mandatory applicable law.
1.10 Intellectual property
The App, its software, design, branding, and the compiled toll dataset are owned by or licensed to the Publisher and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial purposes, subject to these Terms and to the applicable store terms. Map, routing, and geocoding data are provided by third parties (including Mapbox) and remain the property of their respective owners.
1.11 Third-party services
The App relies on third-party services (including Apple, Google, Mapbox, RevenueCat, and toll operators' own systems). We are not responsible for third-party services, their availability, or their content, and your use of them may be subject to their own terms.
1.12 Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Effective date” and, where appropriate, notify you in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms, to the extent permitted by law.
1.13 Price changes
We may change the price of any Pro unlock option — the monthly subscription, the annual subscription, or the one-time Lifetime purchase — at any time, and we may add, withdraw, or change the purchase options we offer.
A price change applies only to purchases made after it takes effect. It is never applied retroactively to a purchase you have already completed.
- One-time Lifetime purchase. If you have already bought the Lifetime unlock, it is honoured at the price you paid. A later price increase does not affect it, and we will not charge you again for it.
- Auto-renewing subscriptions. A price change can only affect future renewal periods, and it takes effect only in accordance with Apple’s and Google’s rules — which require that you are notified in advance and, where their rules or applicable law so require, that you consent to the new price. If you do not accept the new price, you can cancel before the next renewal (see §1.4(b)); your subscription then ends at the end of the current paid period and you are not charged the new price.
- Promotional or introductory prices apply only as, and for as long as, they are shown in the store. They do not create a right to that price on any future purchase or renewal.
The price actually charged to you is always the one shown in the App Store or Google Play at the moment you purchase. This §1.13 does not exclude or limit your mandatory statutory consumer rights — see §1.15.
1.14 What a “Lifetime” purchase means (read with §1.4(a) and §1.7)
“Lifetime” refers to the lifetime of the Diodia app and service — not to your lifetime. It does not mean permanent, guaranteed, or indefinite availability.
As set out in §1.7, we may modify, discontinue, or cease supporting the App or any of its features at any time, for any reason — including if the project is no longer commercially viable.
A Lifetime purchase grants you access to the App’s Pro features for as long as the App continues to operate and remains available on your device. It does not guarantee:
- indefinite or continued updates to the App;
- the accuracy, completeness, or currency of toll data (which is indicative in any event — see §1.3); or
- compatibility with future versions of your device’s operating system, or continued availability of the App in the App Store or Google Play.
To the maximum extent permitted by applicable law, we are under no obligation to provide refunds, credits, or compensation if the App, the service, or a paid feature is discontinued.
This §1.14 is subject to §1.7 and does not exclude or limit any remedy you have under mandatory consumer law, or under the applicable Apple/Google store refund policies — see §1.15.
1.15 Governing law & jurisdiction
These Terms are governed by the laws of Greece, without prejudice to the mandatory consumer-protection rules that apply to you. If you are a consumer, you benefit from the mandatory provisions of the law of your country of habitual residence within the EU, and nothing in these Terms deprives you of the protection of those provisions. Mandatory EU consumer jurisdiction rules are preserved: as a consumer, you may bring proceedings in the courts of your place of residence where the applicable rules so allow.
